Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the Darbcom platform, including our mobile app and company portal (together, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. Who Can Use Darbcom

Darbcom serves two kinds of accounts:

• Drivers: independent truck drivers who hold a valid Saudi driving license, a registered vehicle, and the identity and vehicle documents required for verification (National ID/Iqama, driving license, vehicle registration/Istimara, operation card, and any others we request).
• Companies: logistics companies and shippers who hold a valid commercial registration or operation card and post shipments for drivers to bid on.

Every account is reviewed before it can bid on or post shipments. We may decline or request more documents if verification is incomplete or inconsistent.

3. The Darbcom Marketplace

Darbcom is a marketplace that connects independent truck drivers with logistics companies. We are not a carrier, freight forwarder, or party to the transport contract. When a company accepts a bid, the resulting agreement to move that shipment is between the driver and the company directly, Darbcom facilitates the connection, tracking, and payment flow, but is not responsible for how either party performs the underlying transport.

4. Bidding and Shipments

When using the marketplace:

• Companies post shipments with pickup and delivery details, cargo information, and (where applicable) a minimum and maximum bid price.
• Drivers submit a bid amount, along with an estimated pickup and delivery window.
• A bid becomes binding the moment the company accepts it. Once accepted, the driver is expected to carry out the trip as agreed.
• Withdrawing a pending (not yet accepted) bid is allowed. Withdrawing after acceptance without a valid reason may affect your account standing.

5. Trip Execution and Proof of Delivery

• Once a bid is accepted, the driver confirms pickup and begins the trip. Live location is tracked during an active trip so the company can follow progress.
• On arrival, the driver confirms delivery and submits proof of delivery (a signature and, optionally, a photo). The company then confirms receipt.
• Darbcom may use background location tracking during an active trip, and, if a driver opts in, a general on-duty location between trips. This is covered in more detail in our Privacy Policy.

6. Payments and Wallet

• The bid amount, once accepted, is the price for that shipment. There are no additional platform fees shown to drivers beyond what is disclosed in the app.
• Funds become available in the driver's wallet after the company confirms delivery.
• Drivers can withdraw available wallet funds to a linked bank account.
• Payment disputes should be raised through in-app support so we can help resolve them between the driver and the company.

7. Prohibited Conduct

You agree not to:

• Submit false, forged, or expired identity, vehicle, or company documents.
• Use the platform for cargo or purposes prohibited by Saudi law.
• Misrepresent a shipment, its cargo, its weight, or its condition.
• Attempt to circumvent the platform to avoid fees or bypass verification.
• Engage in unsafe driving conduct, harassment, or abusive behavior toward drivers, company staff, or Darbcom support.

Violating these terms can lead to a warning, suspension, or permanent removal from the platform, depending on severity.

8. Account Verification, Suspension, and Termination

We review driver and company documents before approving an account, and may decline or block an account that fails verification, submits false information, or violates these Terms. You can request account deletion at any time, subject to any records we are legally required to retain.

9. Intellectual Property

The Darbcom name, logo, app, and platform are owned by Darbcom. You may not copy, modify, reverse-engineer, or redistribute any part of the Services without our written permission.

10. Disclaimers and Limitation of Liability

• Darbcom provides the marketplace "as is." We do not guarantee that shipments will always be available, that bids will always be accepted, or that the Services will be uninterrupted or error-free.
• As Darbcom is not the carrier, we are not liable for cargo loss, damage, delay, or any dispute arising from how a driver or company actually performs a transport agreement. Such matters are between the driver and the company.
• To the fullest extent permitted by Saudi law, Darbcom is not liable for indirect or consequential losses arising from use of the Services.

11. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from these Terms or your use of the Services will be subject to the jurisdiction of the competent courts of Saudi Arabia.

12. Changes to These Terms

We may update these Terms as the platform grows. Material changes will be announced in the app or by email. Continued use of the Services after a change takes effect means you accept the updated Terms.
